By using this website or engaging our services, you agree to the terms outlined below. If you do not agree to these Terms, you must not use this website or our services.
1. Overview of Services
SelectiveCare Solutions provides non-medical, in-home care services and temporary staffing for care agencies using qualified Personal Support Specialists (PSS) and Direct Support Professionals (DSP). Our services include:
- Assistance with Activities of Daily Living (ADLs)
- Homemaking and companionship
- Community support for individuals with disabilities
- Temporary staffing placements for residential and agency settings
We do not offer skilled nursing, medical services, or clinical interventions.
2. Eligibility
To use our services, you must:
- Be at least 18 years old
- Be a resident of or operate within the state of Maine
- Provide accurate, complete, and current information
- Agree to these Terms and any applicable service agreements
3. Caregiver Requirements
All caregivers employed or contracted by SelectiveCare Solutions must:
- Complete a Maine DHHS-approved PSS training program, or meet DSP requirements under Section 19, 21, or 29 waivers
- Pass state and federal criminal background checks, per 22 M.R.S. §1812-G and §2149
- Be free of any disqualifying findings on the Maine Direct Service Worker Registry
- Maintain CPR/First Aid certification
- Participate in regular trainings on mandated reporting, safety, boundaries, infection control, and client rights
4. Client Rights
Clients of SelectiveCare Solutions have the right to:
- Be treated with dignity, respect, and cultural sensitivity
- Receive written information about services, rates, and their care plan
- Request changes to service or caregiver assignments
- File complaints or grievances without fear of retaliation
- Receive a minimum of 14 days’ written notice prior to termination or transfer of service (unless there’s immediate risk or non-payment)
5. Staffing for Agencies
- Use staff assigned by SelectiveCare only for intended shifts or contracts
- Not solicit or hire staff independently without prior agreement (a buyout or transfer fee may apply)
- Report safety incidents or violations to SelectiveCare promptly
- Pay invoices as agreed in the staffing contract
Caregivers are employees of SelectiveCare unless otherwise stated in a formal agreement.
6. Supervision and Oversight
All services are monitored by administrative or supervisory personnel trained in non-medical care delivery and Maine DHHS regulations.
- Supervisory visits, documentation audits, and client satisfaction checks are performed regularly
- DSPs and PSSs report to designated team leads or care coordinators who oversee compliance, punctuality, and care quality
7. Payments, Cancellations, and Refunds
For Private Clients:
- Rates are disclosed in writing before services begin
- Clients are billed weekly or monthly, depending on the care agreement
- Cancellations must be made at least 24 hours in advance
- Missed appointments or last-minute cancellations may result in charges
- No refunds for services already rendered
For Agency Clients:
- Invoices are sent weekly or bi-weekly per the staffing agreement
- Short-notice or emergency shifts may incur premium rates
- Failure to pay on time may result in service suspension
8. Prohibited Conduct
You agree not to:
- Misrepresent your identity or intent when registering or requesting services
- Circumvent SelectiveCare Solutions to hire caregivers directly
- Harass, abuse, or endanger any caregiver or staff member
- Share login credentials or access the site in unauthorized ways
- Violate local, state, or federal laws while using the site or services
9. Privacy and Confidentiality
At SelectiveCareSolutions.com, we are committed to safeguarding the privacy and security of your Protected Health Information (PHI) in strict adherence to the Health Insurance Portability and Accountability Act (HIPAA) and its associated regulations, including the HITECH Act. We understand the sensitive nature of health data and have implemented comprehensive measures to ensure its confidentiality, integrity, and availability.
This commitment extends to our selection of a HIPAA-compliant web hosting service, which is a crucial component of our secure infrastructure. Our hosting provider, HIPAAVAULT, has demonstrated their ability to meet the stringent technical, physical, and administrative safeguards required by HIPAA, including:
- Data encryption at rest and in transit
- Robust access controls
- Continuous security monitoring
- Disaster recovery protocols
We also maintain a Business Associate Agreement (BAA) with our hosting provider, clearly defining their responsibilities in protecting PHI.
In addition to external protections, we continuously review and update our internal security precautions, which include:
- Strict access management protocols
- Employee training on HIPAA and confidentiality regulations
- Routine risk assessments
- Incident response planning
These measures are designed to prevent unauthorized access, use, or disclosure of your health information. We are dedicated to protecting your privacy and complying with all applicable federal and Maine-specific health data privacy laws.
10. Limitation of Liability
SelectiveCare Solutions is not liable for:
- Damages arising from interactions between clients and caregivers
- Service interruptions caused by emergencies, caregiver illness, or natural events
- Delays or failures beyond our reasonable control
- Loss of data due to user error, third-party hosting issues, or breach despite reasonable safeguards
11. Grievance & Dispute Resolution
We encourage clients and agency partners to contact us directly to resolve concerns.
- All complaints will be documented and investigated in accordance with 10-144 CMR Ch. 119
- You may also contact the Maine Long-Term Care Ombudsman Program at 1-800-499-0229
- Unresolved legal disputes will be subject to binding arbitration under Maine law in Cumberland County
12. Changes to Terms
We may revise these Terms periodically. Any significant changes will be communicated via email or notice on our website. Continued use of the site or services after such updates constitutes acceptance of the revised Terms.
